Terms and Conditions
These Terms & Conditions apply to all photography, videography, media production and related services provided by OE Visuals (“we”, “us”, “our”) to any individual, business or organisation (“the Client”).
By booking, commissioning or purchasing our services, the Client agrees to these Terms & Conditions unless alternative terms have been agreed by us in writing.
1. Services
OE Visuals provides professional media production services including, but not limited to:
Property and real estate photography
Property and real estate videography
Drone photography and videography
Wedding photography and videography
Event photography and videography
Commercial and corporate production
Social media content
Promotional and advertising content
Interviews and testimonials
Editing and post-production
Other photography, videography and creative media services
The exact scope, deliverables, price and production requirements may be agreed separately through a quotation, booking confirmation, proposal, email, contract or other written agreement.
2. Bookings
A booking is considered confirmed once we have accepted the booking and, where applicable, received any required deposit or booking fee.
The Client is responsible for providing accurate information regarding dates, locations, timings, access requirements and the services required.
Any significant changes to the agreed scope may result in additional charges.
We reserve the right to decline a booking at our discretion prior to confirmation.
3. Pricing & Payment
Prices will be confirmed before the service is carried out unless the Client operates under a separately agreed pricing structure.
Invoices must be paid within 1 week of the invoice date.
Where a deposit or booking fee is required, the booking may not be secured until payment has been received.
Additional services, additional shooting time, travel, revisions or deliverables requested outside the original scope may be charged separately.
We reserve the right to withhold final deliverables until outstanding invoices relating to the project have been paid.
Late payments may be subject to applicable statutory interest and recovery costs where permitted by UK law.
4. Cancellations & Rescheduling
Cancellation and rescheduling terms may vary depending on the type and scale of production.
Where a Client cancels a confirmed booking at short notice, we reserve the right to retain any booking fee or deposit and/or charge a cancellation fee where appropriate (this typically is 50% of the full project price).
Any applicable cancellation fee will reflect factors such as notice provided, work already completed, expenses incurred and production time that had been reserved.
Where possible, we will attempt to accommodate requests to reschedule.
Repeated rescheduling or substantial changes to a booking may be treated as a cancellation and new booking.
For weddings, events and larger productions, separate cancellation terms may be specified within the Client's individual contract or booking agreement.
5. Property Photography & Videography
The Client, property owner, estate agent or relevant representative is responsible for ensuring that the property is ready for photography or filming at the agreed arrival time.
This includes, where appropriate, cleaning, tidying, staging and removing personal or unwanted items.
Unless specifically agreed, our photographers and videographers are not responsible for cleaning, moving furniture or extensively staging a property.
We will make reasonable creative decisions regarding composition, lighting and presentation based on the condition of the property at the time of the shoot.
Additional editing requested to remove, replace or significantly alter objects or elements within a property will incur an additional charge.
6. Weddings & Events
For weddings and live events, we will make reasonable efforts to capture important moments, individuals and details. However, due to the unpredictable nature of live events, we cannot guarantee that every person, moment or requested shot will be captured.
The Client is responsible for informing us of important timings, restrictions, locations and specific requirements before the event.
We are not responsible for missed coverage caused by circumstances outside our reasonable control, including delays, venue restrictions, guest interference, weather, lighting conditions or changes to the event schedule.
7. Creative Control
By booking OE Visuals, the Client acknowledges that they are commissioning us based on our portfolio, creative approach and production style.
We retain reasonable creative control over matters including composition, camera positioning, lighting, shot selection, editing, colour grading, music selection and the overall presentation of the final work unless specific requirements have been agreed beforehand.
Creative differences alone do not constitute a defect in the service or automatically entitle the Client to a refund.
8. Editing & Revisions
Standard editing and post-production appropriate to the service purchased are included unless stated otherwise.
Where revisions are included they will be limited to the number (Typically 3), or scope agreed for the project.
Additional revisions or substantial changes requested after delivery may be charged at our current editing or production rate.
Requests that materially change the original creative brief may be treated as additional work.
9. Delivery Times
Any delivery dates or turnaround times provided are estimates unless expressly agreed as fixed deadlines in writing.
We will make reasonable efforts to deliver work within the estimated timeframe but cannot guarantee delivery dates where delays arise from circumstances outside our reasonable control.
Urgent or expedited delivery may be available for an additional fee.
10. File Storage
Clients are responsible for downloading and securely storing their final delivered files.
We may retain project files, raw footage and final deliverables for 3 months following delivery, but we do not guarantee permanent storage or archival of Client files unless this has been specifically agreed.
We recommend that Clients maintain their own backups of all delivered media.
11. Raw Files
RAW photographs, unedited video footage, project files, timelines and other working production materials are not included as standard deliverables unless specifically agreed in writing.
Requests for raw or project files will incur an additional fee and are subject to availability.
12. Copyright & Usage
Unless otherwise agreed in writing, copyright in photographs, videos and other original creative work produced by OE Visuals remains with OE Visuals.
Upon full payment, the Client receives the agreed licence to use the final delivered content for its intended purpose.
The Client may not sell, sublicense or materially alter the work for purposes outside the agreed usage without our permission where such permission is required.
Where content is created for commercial advertising, paid media, third-party licensing, broadcast or other significant commercial usage, additional licensing terms may apply.
13. Portfolio & Promotional Use
Unless otherwise agreed in writing, OE Visuals may use work produced for Clients within our portfolio, website, social media, showreels, advertising and other promotional materials.
For sensitive, confidential or unreleased projects, the Client should notify us before production if the content must not be publicly shared.
Where privacy or usage arrangements are covered by a separate written agreement, those terms will take precedence.
14. Music & Third-Party Content
Where music, fonts, stock footage, graphics, templates or other third-party assets are incorporated into a production, their use may be subject to third-party licensing conditions.
Where we obtain a licence for a specific production or platform, that licence does not necessarily give the Client unrestricted rights to reuse the asset separately or on other platforms.
The Client is responsible for informing us where content will be used for television, cinema, paid advertising, large-scale campaigns or other uses requiring specialist licensing.
15. Drone Operations
Drone photography and videography are subject to weather conditions, airspace restrictions, location restrictions, safety considerations and applicable laws and regulations.
We reserve the right not to operate a drone where our operator considers the flight unsafe, unlawful or inappropriate.
Where drone coverage cannot be completed due to circumstances outside our reasonable control, we will attempt to provide an appropriate alternative where reasonably possible.
16. Permissions & Access
Unless otherwise agreed, the Client is responsible for obtaining permission for us to photograph or film at the relevant property, venue or location.
The Client must inform us of any restrictions affecting photography, filming, drone operations or access.
Additional charges may apply where delays occur because access has not been arranged or a location is not ready at the agreed time.
17. Client-Supplied Materials
Where the Client supplies logos, photographs, video, music, graphics, trademarks or other materials, the Client confirms that they have the necessary rights and permissions for us to use those materials as instructed.
OE Visuals will not be responsible for claims arising from Client-supplied materials where we have used those materials in accordance with the Client's instructions.
Where a project requires the Client to provide materials such as logos, brand guidelines, fonts, graphics, images, copy or other assets, these must be supplied within the agreed timeframe.
Delays in providing required materials may affect the agreed production and delivery schedule. Where such delays result in additional editing, administration, rescheduling or production time, additional charges may apply. OE Visuals will not be responsible for missed or delayed delivery deadlines where required materials have not been supplied by the Client in sufficient time.
18. Equipment Failure & Unforeseen Circumstances
We maintain and operate professional production equipment and take reasonable precautions to protect Client work.
However, in the event of circumstances outside our reasonable control; including serious equipment failure, data corruption, illness, accident, severe weather, travel disruption, venue restrictions or other events preventing performance; our liability will be subject to applicable law and the circumstances of the booking.
Where reasonably possible, we may arrange alternative personnel, equipment, rescheduling or another appropriate solution.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
19. Freelancers & Subcontractors
OE Visuals may use trusted photographers, videographers, editors, drone operators, assistants or other freelancers and subcontractors to complete bookings.
The Client acknowledges that the individual attending a shoot or carrying out part of the production may therefore be an authorised member of our wider production team rather than a specific individual, unless a particular person has been expressly agreed as part of the booking.
20. Client Conduct & Safety
We reserve the right to stop or refuse work where our team reasonably believes that working conditions are unsafe, unlawful, abusive or inappropriate.
Where work cannot be completed because of unsafe conditions, threatening behaviour or circumstances created by the Client or people under the Client's control, the Client may remain responsible for the agreed fees.
21. Liability
We will provide our services with reasonable care and skill.
To the fullest extent permitted by law, OE Visuals will not be responsible for indirect or consequential losses arising from the use, publication or inability to use delivered media.
Where legally permitted, our total liability relating to a particular booking will not exceed the amount paid or payable to us for the services giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
22. Social Media & Third-Party Platforms
We are not responsible for changes made by Instagram, Facebook, TikTok, YouTube, property portals, websites or other third-party platforms that affect the quality, formatting, cropping, availability or performance of delivered content.
We cannot guarantee any particular number of views, enquiries, leads, sales, bookings or other commercial results from content we produce.
23. Complaints
Any concerns regarding delivered work should be raised as soon as reasonably possible after delivery.
We will make reasonable efforts to resolve genuine issues with our services.
Where an issue can reasonably be corrected through editing or another remedy, we may be given a reasonable opportunity to correct the issue before a refund or other remedy is considered, subject always to the Client's statutory rights.
24. Data Protection & Privacy
Personal information provided to us will be handled in accordance with applicable UK data protection legislation and our Privacy Policy.
Client information will only be used where reasonably necessary to administer bookings, communicate with Clients, deliver services, process payments and operate our business, or where another lawful basis applies.
25. Consumer Rights
Nothing within these Terms & Conditions is intended to remove, restrict or override any rights that a consumer has under applicable UK consumer protection law.
Where these Terms conflict with rights that cannot legally be excluded or restricted, the applicable statutory rights will take precedence.
26. Changes to These Terms
We may update these Terms & Conditions periodically.
The version applicable to a booking will generally be the version in effect when the booking or agreement is made, unless changes are subsequently agreed between us and the Client.
27. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights available to consumers.
28. Acceptance
By confirming a booking, paying a deposit or booking fee, accepting a quotation or instructing OE Visuals to begin work, the Client confirms that they have read and accepted these Terms & Conditions.
